      Since May 25, 2018, the General Data Protection Regulation (GDPR) is in force. The GDPR, officially Regulation (EU) 2016/679 of 27 April 2016, is an EU regulation of 88 pages with 99 articles and 173 'Considerations'. It applies to any person or organization that collects or processes personal data in the EU or outside the EU. It is considered for persons living in the 28 Member States of the European Union or non-Europeans living in the EU. It also applies to non-EU countries belonging to the European Economic Area (EEA) by extension (Liechtenstein, Norway and Iceland).       With the GDPR, the EU is trying to find a new balance between the privacy of its citizens and the collection of personal data by companies. Anyone who collects, uses or processes personal data on behalf of someone else must know and follow the new rules. What is new about the GDPR and, more importantly, what does this mean for your company or organization? Because privacy legislation is of course not really a new topic. Ever since the adoption of the Universal Declaration of Human Rights in 1948, there has been a tension between the right to privacy, free speech and the free movement of goods and services.

You may also have to convert this information into a formal Register of personal data processing. Determining whether this Register is mandatory in your case can be a difficult matter.      Who has the right to process personal data? When is permission required and when is there a legitimate interest?
     When drafting the register of processing of personal data, it is also best for the controller to lay down the legal basis, even if this is not an obligatory part of the register. For a legal use of the data, there must be a specific purpose and a demonstrable legal basis for the processing. Moreover, the processing must follow the rules of subsidiarity and proportionality. In other words, it must be necessary and proportionate to the goal. The GDPR provides several possible legal grounds that are not applicable in all cases. It is important to think carefully about the ground you have before you start processing. This process must be documented and can subsequently play an important role in disputes or complaints.

     What is a privacy statement and what should be in it? In the previous lesson, we discussed the registration of personal data extensively. In it, you record which personal data are processed in your organization, for what purpose this happens and what the legal basis for this is. If your organization wants to comply with the GDPR, you must have such a register. However, the usefulness of this register goes much further. You can perfectly take it as a starting point for risk analysis and for an overview of the protection measures and internal procedures of your organization. On the other hand, a well-kept register also provides the right input to inform those concerned about the processing of their data. We will discuss the latter in this lesson. After all, the GDPR requires that you are open and transparent for all parties involved, in other words for all persons whose data you use. It is their right to know how you process their data. A text in which you, as an organization, make this information public, is called a 'privacy statement'.

     Up to this point, we have mainly discussed the GDPR guidelines for the actual processing of personal data in this e-learning. Under which conditions can you process data? How do you ensure the right communication with those involved? In addition, the GDPR also prescribes that you must adequately protect the data against risks, both during processing and beyond. Of course, the duty of information security already existed in the previous legislation.
What is new in the GDPR is that not only the controller is liable, but also every processor who processes personal data on behalf of a controller. In order to clarify how you can comply with this obligation, we need to consider what information security is. Larger organizations or firms that systematically handle confidential data from their customers are familiar with this. There are various standards for information security, of which ISO 27001 is the best known. A whole range of policy documents, procedures and work instructions support organizations and their management. This is a 'science' in itself.

     In this E-learning, we have so far mainly discussed the obligations that the GDPR entails for companies or organizations that process personal data. We have mainly looked at the law from the point of view of the controller and the processor. It is time that we shift the focus to the person concerned. After all, the main purpose of the GDPR is to establish the rights as an individual person for the many data that circulate about you and that are used by others. As a data subject, you can indeed keep a grip on this information, even if your rights are not absolute.
